Under Australian legal principles and, specifically, the Mental Health Act 2007 (NSW) and the Australian Privacy Act 1988, individuals aged 18 and over are presumed to have the capacity to make independent decisions about their treatment and privacy.
We respect this autonomy and work diligently to empower our clients to take charge of their mental health, while also ensuring that, if needed, parental or carer involvement can be incorporated through explicit consent or if a formal capacity assessment deems it necessary, in line with the NSW Guardianship Act 1987.

Rights and Responsibilities of an Adult Undergoing Psychological Treatment

- Involvement of Others: While the client maintains primary decision-making authority, they may choose to involve family members or carers in their treatment. Such involvement occurs only with their explicit consent.

Payment of Sessions
If a private third party, such as a family member, friend or carer, is covering the cost of a client’s psychological treatment, it is essential that they provide approval for the treatment plan in advance.

Pre-approval ensures transparency in the financial arrangement while maintaining the client’s autonomy in their therapeutic journey. Prior to commencing treatment, the paying party will be required to review and sign a financial consent form, confirming their agreement to fund the sessions as outlined in the treatment plan.
It is important to note that while they may be financially responsible, all therapeutic discussions, treatment decisions, and confidential client information remain solely within the client’s control unless the client provides explicit written consent for information to be shared. This process upholds ethical standards, respects client privacy, and allows the individual to engage in therapy with independence while ensuring financial clarity for all parties involved.
